SCHIPHOL - Een illegaal is het tot twee keer toe gelukt zijn uitzetting te voorkomen door glas in te slikken. De man braakte het glas op kort voor zijn vertrek op Schiphol. Hij wilde daarmee zichzelf verwonden. Als iemand die wordt uitgezet een gevaar vormt voor zichzelf of anderen aan boord van het vliegtuig, gaat de uitzetting niet door.

Illegalen worden voor hun uitzetting gevisiteerd, aldus een woordvoerder van de Koninklijke Marechaussee. Dat gebeurde ook bij deze man. Hij had aanvankelijk niks in zijn mond. "Op een of andere manier weet hij het glas later op te braken. Levensgevaarlijk natuurlijk, maar dat maakt hem kennelijk niet uit", aldus de woordvoerder. Hij spreekt van een nieuwe vorm van verzet.

Op 12 juli werd voor het eerst geprobeerd de man uit te zetten. Toen de marechaussees die hem begeleidden ontdekten dat hij iets in zijn mond had, slikte hij dat door. Een ambulance werd erbij gehaald en onderzoek wees uit dat hij glas had doorgeslikt. Het leverde de illegaal verder geen verwondingen op. Hij ging terug naar het Vertrekcentrum Ter Apel.

Marechaussee

Deze week werd een nieuwe poging ondernomen. Onder begeleiding van drie marechaussees en geboeid omdat hij zich hevig verzette, ging de man het vliegtuig in. Op de vliegtuigtrap ontdekten de marechaussees weer glas in zijn mond. Ze wisten het uit zijn mond te halen, maar de man was wel gewond. De uitzetting werd opnieuw afgeblazen.

Uitzettingen

Uitzettingen verlopen vaker moeizaam. Illegalen schromen niet zichzelf te verwonden om hun uitzetting te voorkomen. Ze slaan bijvoorbeeld met hun hoofd tegen de muur. De marechaussee hoopt daarom snel gebruik te mogen maken van piepschuimen maskers. Die helpen verwondingen voorkomen en beschermen marechaussees ook tegen bijten. In het gevangeniswezen zijn deze maskers bekend, maar de marechaussee mag ze nog niet gebruiken, aldus de woordvoerder. Een op handen zijnde wetswijziging moet dit veranderen.

Illegalen verzinnen allerlei vormen van verzet. De marechaussee wordt ook vaak geconfronteerd met mensen die zich helemaal hebben ingesmeerd met hun eigen ontlasting. Een woordvoerder noemt dat inmiddels geen probleem meer. "Ze gaan onder de douche en krijgen vervangende kleding."

De ziekeling. Het lijkt me nogal pijnlijk om glas in te slikken. Hij moet wel een goede reden hebben om hier zo graag te willen blijven...
Als toch blijkt dat hij best kan terugkeren, moet hij streng bewaakt worden, alvorens hij op het vliegtuig wordt gezet, zodat hij geen glas-praktijken kan uitvoeren.

Precies gewoon in dat vlieguig proppen en afvoeren. Moet ie zichzelf maar niet verwonden om onze staat nog meer op kosten te jagen. Uitgeprocedeerd is nu eenmaal uitgeprocedeerd.

Waarom zou iemand een glas willen inslikken?
Lijkt me nogal logisch, oftewel een glas inslikken in een laatste wanhopige poging je verblijf nog wat verlengd te zien oftewel het land uitgezet worden en wanneer je terugbrengt direct afgeslacht worden.

Waarom zou iemand een glas willen inslikken?

Dus jongens iedereen die glas inslikt mag blijven want die meot zo wanhopig zijn

Wat een onzin, zo'n persoon is uitgeprocedeerd en moet het land uit maar heeft geen zin al de luxe welke hij/zei in Nederland vergaard heeft af te geven en hij/zei weet dat als je jezelf verwond dat je dan weer even mag blijven.

Ze kunnen het beste DNA materiaal van die mensen afnemen en opslaan. Dan kunnen ze ze meteen weer checken als ze nog een keer het land binnenkomen.

Ze worden al opgeslagen in een database. Moeilijk om dan nog een keer ongemerkt asiel aan proberen te vragen.
Ergo, heel EU weet of je ergens binnen de EU al asiel hebt aangevraagd zodat men kan kijken of de Dublin-procedure in gang gezet kan worden (dat wil zeggen of je in het land waar je eerst was je de asielprocedure daar kan afhandelen in plaats van in het land waar je nu zit).

Daarnaast: dat kost je nog eens zoveel geld. Waarschijnlijk heb je dat gewoon niet.

Asielzoekers zijn geen beesten, het zijn ook maar mensen.

Mensen die op zoek zijn naar een betere toekomst. Mensen waarvan hun verleden veel getekend wordt door oorlog, bloed, geweld,...

Mensen onmenselijk behandelen is nergens voor nodig. Een beetje begrip voor hun situatie proberen op te brengen zou een goed begin zijn.

We hebben in Nederland regels opgesteld voor de procedure. ALs hieruit blijkt dat je weg meot moet je weg en dat doen we echt niet zomaar hoor. Het is terecht omdat de wet altijd gelijk heeft, totdat deze wet word vervangen door een nieuwe.

Ik weet genoeg van asielprocedures aangezien ik hier zelf redelijk wat onderzoek naar gedaan heb, ik mensen binnen asielzoekerscentra ken en daar vaak mee spreek en ik directe contacten heb binnen IMD (immigratie en naturalisatie dienst) ik heb dus een kijkje achter de schermen. Lijkt me genoeg mijn inziens om daar een behoorlijke mening over te vormen.

het gaat hier niet over asielzoekers, maar over gelukzoekers. Mensen die uitgezet worden, zijn hier onterecht. Deze mensen hoef je niet al;s asielzoekers te behandelen die veel nare dingen jebben meegemaakt.

- Men maakt vooral gebruik van de verkorte AC-procedure waarin asielaanvragen binnen de 48 uur afgehandeld worden. Te kort om een duidelijk beeld te vormen
- Asielzoekers hebben tijdens bepaalde periodes van hun uitzettingsprocedure geen recht op de basisvoorzieningen zoals o.a. eten, bed,...

Je kunt sterk betwijfelen of de wet wel degelijk gelijk heeft. Zelfs als het zwart op wit staat dat bepaalde mensen geen vluchteling zouden zijn, wilt dat niet zeggen dat ze geen vluchteling zijn.
Daarnaast staat onze procedure los van het internationaal recht aangaande vluchtelingen. Dat wil zeggen: we hebben onze eigen wetten en regels, ja, maar deze voldoen niet aan de norm van een procedure die een vluchteling geacht is te krijgen.
Dit wetende, heb ik je daarom bovenstaande vragen gesteld.

wat wil jij dan? 10 jaar over een procedure doen? en dan de mensen hier maar houden omdat het zo lang geduurd heeft?

Als jij in een Marokkaans bergdorpje woont of in een Afrikaans hutje en je krijgt de mogelijkheid naar 'Ollanda te gaan om geld te verdienen, doe je het ook. Een goed asielbeleid begint dan ook bij ontwikkelingssamenwerking.

We kunnen trouwens beter asielzoekers in kampen laten wonen die afgesloten zijn van de samenleving. Dit klinkt misschien vreemd, maar dan zul je alleen de echte vluchtelingen hier krijgen, en geen gelukzoekers. En zodra het weer veilig is in eigen land, gaan ze weer terug omdat het niet bepaald leuk is om op die manier te leven. En toch bereik je hiermee het doel, om de mensen veilig te stellen van de situaties in hun eigen land.

Nog beter is om mensen in hun eigen land op te vangen. Dan kunnen veel meer mensen worden opgevangen, en ook de juiste mensen. Anders kunnen de arme mensen geen veilig onderkomen krijgen omdat ze geen ticket kunnen betalen. Op deze manier is het dan ook voor die mensen makkelijker om een veilig verblijf te krijgen.

En natuurlijk moet het probleem zelf worden aangepakt. Want eigenlijk is het opvangen van asielzoekers maar een tijdelijke oplossing. Door een dicator zoals Sadam te verdrijven help je miljoenen mensen, door alleen asielzoekers op te vangen slechts enkele duizenden.

EEN GELUKSZOEKER IS GEEN ASIELZOEKER.

En als buitenlanders naar NL willen emigreren, mag dat van mij best. Als ze de taal maar goed beheersen, en goed integreren.
Dat is dus wat anders dan illegaal het land binnen komen en alles bijelkaar stelen zoals velen (en lees dus niet iedereen) doen.

The UNHCR admits that there are also other reasons why people flee; yet they “don’t legally qualify as refugees”. I won’t discuss whether the reasons named by the convention are incomplete - taking into account that the question whether the Dutch Asylum law should remain, be changed or be cancelled is the main (complex) question of this paper -, but I would like to add the reasons summed up by the Human Rights Watch (war, civil conflict, political strife or gross human rights abuses) to the list of reasons embedded in the 1951 convention.

1.2 When are you a refugee and what rights have refugees got?

According to international refugee law a person is a refugee whether or not a legal eligibility procedure has already recognised that status. Governments set up status-determination procedures, for the purposes of determining that person’s legal standing and/or rights and benefit, in accordance with their own legal system (= asylum policy). Determining whether a person meets the criteria of a refugee status is depending on the country whereto this asylum law applies to. The UNHCR offers advises and offers a “Handbook on Procedures and Criteria for Determining Refugee Status” – which is considered an authoritative interpretation of the 1951 Convention by many states, which states could use. According to the United Nations one is an eligible refugee when one meets the 1951 Convention (already cited in the paragraph above “Why do refugees flee?”)

According to the 1951 Convention and 1967 Protocol which form the foundation of international refugee law a refugee has the right to safe asylum. Refugees should receive at least the same rights and basic help as any other foreigner who is a legal resident, including certain fundamental entitlements of every individual. These basic rights include freedom of thought, of movement, and freedom from torture and degrading treatment.

The way we should treat refugees seeking asylum is established by rules which make it possible to pursue basic human values. One of the principles refugees can count on is the non-refoulement principles. This principle – which found its way into the body of customary international law (binding even those states which haven’t ratified the 1951 Convention or 1967 Protocol) – means that a state ought not return persons to other States in certain circumstances.

The obligation refugees have is that they should conform to the laws of their country of asylum.


1.3 Why should we protect refugees?

Many people around the globe can rely on their governments who will guarantee and protect their basic human rights . Concerning refugees, however, the government (or another powerful authority) of their country of origin isn’t able or willing to protect these rights. There are organisations like the UNHCR, Amnesty International, Medicins sans Frontieres who are trying to help and protect these refugees. And not only refugees. The United Nations High Commissioner for Refugees (UNHCR), for example, “provides assistance not only to refugees, but also to other categories of displaced or needy persons (e.g. asylum seekers, refugees who have returned home but still need help in rebuilding their lives, local civilian communities which are directly affected by the movements of refugees and, perhaps most importantly, growing numbers of internally displaced persons (IDPs).”
Despite the help of the organisations many people aren’t helped via this way and flee to other countries, like e.g. the Netherlands, to seek asylum there. UNHCR estimates that the total of refugees world-wide amounts to 20 million refugees.


Why should we help these people fleeing from human rights violations?

In his article “Asylum: the Law and Politics of Change” Goodwin-Gill states correctly that asylum as protection is the necessary reserve side of the coin of tolerance. As tolerance is a basic element in the democratic process because it is functionally linked to the principles of representative government and to participation by the people in public life, (democratic) countries should behave tolerant towards protecting refugees. This protecting means that the necessity for flight should be avoided by creating and preserving stable, civil societies. Because where there is a lack of protection, displacement soon follows. Therefor we should prevent states disintegrating and new national entities struggling to emerge, so that there will be no violations of human rights resulting from this. Flight and migration are perfectly rational responses to a particular situation and one cannot shut his or her eyes for it, pretending this doesn’t exist. As we would like to be helped ourselves when we would endure a difficult set of conditions in which many refugees find themselves now, we have the duty to help the current refugees fleeing at this moment. And not only because we have the moral duty to, but also because we are capable to.

2.2 Critics on the Dutch Asylum Law

The Dutch government appears to fail in giving enough protection to the refugees, who don’t get any protection from their country of origin. The government is focussing more on what the plights are of the refugees, rather than focussing on their own plight of respecting the rights of the refugees from the beginning when they are entering the country or refugees elsewhere in the world.
The Dutch government didn't raise a voice towards e.g. Turkey and Iran when they weren’t willing to accept Iraqi refugees fleeing from war. As everyone has the right to seek asylum (see Universal Declaration of Human Rights), the Netherlands could have addressed the countries not willing to accept Iraqi refugees, but they didn't.
Concerning the Dutch asylum law this sounds pretty odd. Because as many Dutch political parties are showing more and more interest in taking care of refugees in the neighbouring countries of their country of origin, rather than letting them come over to their own country - the Netherlands -, they seem not to be interested in guaranteeing one's safety in the neighbouring countries. While Amnesty International e.g. warns that exclusive refuge and status determination in a neighbouring country of the refugee's country of origin won’t improve the juridical and physical protection of the refugees (who require international protection!), because they still fear persecution or violence. Neighbouring countries cannot always guarantee (even when they are willing to) safety for the refugees: e.g. refugees from Sierra Leone couldn't get a refuge in neighbouring country Liberia, and refugees from Liberia couldn't get a safe refuge in neighbouring countries Sierra Leone, Guinea or Ivory Coast.
Thus when the Dutch government is willing to help neighbouring countries in giving refugees a safe refuge, they should consider if this is possible either financially, juridically, socially and physically. If that would be the case the Dutch government should address the countries (e.g. Iran) who are still not wanting to co-operate in accepting refugees (e.g. Iraqi refugees fleeing to Iran) as they too have the plight to guarantee safety of the refugees according to International Law. If it wouldn’t be possible for a neighbouring country to guarantee the safety of the refugees then the Dutch government - among other safe havens - should allow to let the refugees seek asylum in the Netherlands (or other safe havens).

Even though the Dutch government allows all refugees to seek asylum in their country, the asylum law it handles seems not to respect international standards as how it should do. This is shown by the procedure the refugee has to undergo. As is said in the former chapter "Dutch asylum law in short" a refugee will be examined first how s/he managed to reach the Netherlands and general information (personal details, details of family, travel documents, proofs of identity) will be obtained. The refugee won’t be asked why s/he fled. Based on this examination the IND will decide whether the refugee has to follow the short or long procedure. In the Netherlands a very high percentage of requests for asylum has gone through the short procedure. According to some political parties 80 percent of the requests can be rejected in 48 hours. The possibility exists that a refugee will be send back inequitably to the country of origin. Especially victims of rape as torture might not be considered to be an eligible refugee, because they bluntly weren’t able to tell about this severe torture within 48 hours. As Amnesty International notes: "Rape sometimes appears to be used as a form of torture because those responsible realise that their victims may be constrained from revealing what has occurred after their release from custody. The same associated with rape can be a strong inducement to silence." Beside this cultural obstacle it is also difficult for many - because they are traumatised - to talk about war, persecution, torture or rape and therefor they should need more time given to tell their story. That is why you cannot always take care of all asylum requests just once and for sure not within 48 hours.

An asylum seeker who won’t be stated a refugee after the 48 hours procedure, can still go into court to fight this decision made by the IND. Asylum seekers have no right for accommodation, though, according to the Dutch asylum law. Even though they aren’t illegal residents in the Netherlands as they are still waiting their final decision via the court. The problem we are facing here is that it is hardly possible for the asylum seeker to prepare oneself decently for the lawsuit when it has no elementary provisions like shelter. An asylum seeker who is waiting for his or her final decision via the court has the right for proper refuge to make a meaningful and careful juridical process possible.
Also when a refugee requests a second asylum request he or she has no right for refuge.


It is also to be questioned whether the information the IND is basing itself on during the decision-making is valid enough. As F.W. Verbaas (social worker, law division) writes in the Dutch Newspaper “De Volkskrant” at the 30th of November 2002: “By sending back asylum seekers the Dutch government bases itself on ‘official documents’ and not on advises from the UNHCR or Amnesty International, (…) That the Dutch government is rejecting the points of view and advises of international independent organisations, like the UNHCR, Amnesty International or medicins sans frontieres, is in the current hardened asylum policy rather a rule than an exception. (…) [the country] Somalia, where there had been a civil war since 1991 and where no central government is functioning anymore (…) is dominated by rival clans, by which the smaller ones – who haven’t got own militias – are continuously in danger of being molested. According to the UNHCR and Amnesty International these members of these clans are to be regarded as refugees according to the Geneva Convention. They are in danger in Somalia. The Dutch government, though, believes that these people can go safely to the Northeast of Somalia.”


Asylum Lunacy

3.1 Asylum Lunacy: an introduction

Countries and their asylum law
Oxford University’s Professor of International Refugee Law Goodwin-Gill believes that not the 1951 Convention is the problem with asylum policy, but the systemic inefficiency. This problem is an overall problem and not just occurring in the British asylum policy.
The problems we are facing internationally with refugee law are an inadequate refugee definition, a deficient system of obligation and an apparent lack of capacity or political will.

States have an highly individualistic conception of persecution, they won’t do a case by case approach because those are too expensive and they connect a possible refugee status too much with the integration matter (e.g. temporary refuge), which makes the intern politics rather more important than international law.

The second problem is that no treaty has followed the convention and protocol to make the grant of asylum a matter of individual right, nor to integrate a scheme of asylum and solutions into a normative system founded on international co-operation. And as many states agree that those fleeing armed conflict or internal disturbances deserve protection, but many also say that this is discretionary (there is no legal right of non-refoulement for non-1951 Convention refugees), there is no balance to be found between states in international law concerning the obligation of protecting refugees.

Furthermore many states apparently have a lack of capacity or political will. As Goodwin-Gill argues in his paper “How to end asylum lunacy?”: “(…) we never think outside the box. Whether we are British, German, Danish or Irish, we still see ourselves as some sort of neo-Victorian sovereign state, actually able to isolate ourselves physically from people and events. We react to symptoms of the moment, not stopping to consider where the refugees come from, or our role in their reasons for flight.”
Lack of capacity may be because of financial or physical problems (no money, no space), but also because of social problems. As Kooijmans writes in a reaction to Goodwin-Gill’s article “Asylum: the Law and Politics of Change” concerning the Netherlands: “Society is like a rubber ball. If you punch it, it bounces back and it can absorb quite a number of punches. If you punch it too often at one spot, it may loos its elasticity on that spot and loose its absorbing capacity. It seems that our society has lost its capacity to absorb people from foreign origin. Their presence here has become our sore spot.”

Female refugees
International refugee law faces an own problem that Nahla Valji mentions in her paper “Seeing refugee women as refugees”: the dominant perception of asylum seekers as politically active males. This means that they negate the persecution faced by women and making it more difficult for women to meet the legal criteria for refugee status. Yet, thanks to post-modernist thought which led to an academic reassessment of accepted social constructs and long held assumptions, the area of forced migration led itself to a re-evaluation of traditional asylum determination processes to reflect a wider range of persecutory experiences.
Even though this beneficial situation occurred for female refugees, the way which is still dealt with these different kind of persecutions is far from perfect. Where do international asylum practices actually fail concerning this?
Women may face persecution through cultural practices that are based on an assumption of the inferior status of women, e.g.: female genital mutilation, widow and bride burnings and child marriages. Women may also be subject to severe punishments for transgressing social mores that confine them to a certain role in society.
International refugee law forgets that women asserting their independence are actually claiming certain rights and therefor taking an inherently political stand. The doctrine of patriarchy is often not recognised as a politically held belief but seen as something personal.

Another difference between female and male reasons of persecution lays in the political activities themselves. The conventional activities such as attending protests and joining political parties aren’t always ways of political actions women are involved in. In the context of international refugee law other ways of political actions such as providing community services, food and shelter to activists, are often misinterpreted as personal activities.

The type of persecution suffered by women can also be different. Using rape as a torture can harm a woman more than when this kind of torture is practised on a man. Whilst women may be persecuted twice over: once during the act and secondly by the isolation and silence it imposes on her (as in some societies rape brings tremendous shame and perhaps even social exclusion) which prevents her from seeking help.
Using rape as a weapon in modern warfare is only recently, but fortunately, recognised by international bodies as a political method (e.g. during the tribunals for war crimes in Yugoslavia rape was condemned as a crime against humanity). However, for most women human rights violations occur not during wartime, but in the private sphere of every day life. Even though a state has the obligation to protect their citizens, the state where abuse of women is widespread, seem unwilling or unable to protect these human beings.

Een persoon die asiel aanvraagt is per definitie een asielzoeker en behoort ook de behandeling van een asielzoeker te krijgen.

En als vluchteling ga je geen emigratieprocedure in, want je moet direct je land uit en kan geen bureaucratische rompslomp veroorloven want dat kan je dood betekenen.

En als je basisvoorzieningen weglaat voor vermeende gelukszoekers. Dit bepaal je bijvoorbeeld uit het land van herkomst. Dat wil dan zeggen dat bv. alle Marokkanen (niet dat dat er veel zijn in de asielprocedure overigens) per definitie geen basisvoorzieningen krijgen, terwijl er best 1 tussen kan zitten die "terecht" asiel aanvraagt.
Je kunt wel verwachten dat deze Marokkanen die niet die voorzieningen krijgen zich toch in hun onderhoud willen zien en dit gaan compenseren door OF te jatten OF helemaal de illegaliteit in gaan - in de tuinbouw ofzo.
